This Privacy Policy explains how StillHere (“Service”) handles information when You use our application. Please read this Privacy Policy carefully. By using the Service, You agree to the practices described in this policy.

2. Introduction

StillHere uses Apple’s iCloud (CloudKit) to synchronize data between connected devices. Your data is stored exclusively in Your personal iCloud account and is never uploaded to any server controlled by the Developer. The Developer does not operate any backend servers or databases that store user data.


3. Data We Handle

StillHere stores the following data in Your personal iCloud account:

  • Check-in records (timestamps and status)
  • Photos and messages shared between connected devices
  • Emergency contact information
  • Senior profile settings (name, photo, phone number, FaceTime contact)

This data is stored exclusively in Your iCloud account. The Developer does not have access to Your data.

Third-Party Services

  • Apple iCloud (CloudKit): All data synchronization is handled through Apple’s CloudKit service. Apple’s privacy policy applies to the storage and processing of this data.
  • Apple Push Notification Service (APNs): StillHere uses APNs to deliver check-in reminders and alerts. Notification tokens are managed by Apple. The Developer does not store or process push notification tokens on any external server.
  • Apple App Store: All payment information is handled securely by the App Store. The Developer does not have access to Your payment card data.

4. What We Do NOT Collect

We do not collect or store:

  • Personal identifiers on our servers
  • Device location data
  • Browsing history
  • Analytics or tracking data
  • Advertising identifiers
  • Cookies or similar tracking technologies

We do not use any advertising, ad-tracking, or analytics tools. All data stays in Your iCloud account.


5. Legal Basis for Processing (GDPR)

As the Developer is based in Germany, the General Data Protection Regulation (GDPR) applies. The legal basis for handling Your data is:

  • Contract performance (Art. 6(1)(b) GDPR): Processing is necessary to provide the Service You have requested, including synchronizing check-in data and settings between connected devices.
  • Consent (Art. 6(1)(a) GDPR): Where applicable, such as when You enable push notifications or share photos within the app.

Since all data is stored in Your personal iCloud account and the Developer does not access or process this data on any external server, the Developer acts as a facilitator of data storage rather than a data controller in the traditional sense. Apple Inc. acts as the data processor for iCloud-stored data under Apple’s own terms and privacy policy.


6. Data Sharing

We do not share any data with third parties. All data synchronization happens through Apple’s iCloud service between devices You have connected within the app.

When You connect a Senior and Family device using a connection code, the connected devices share check-in data, photos, and settings through a shared iCloud container. No data leaves the Apple ecosystem.


7. Data Retention

Your data is retained in Your iCloud account for as long as You use the Service. Since the Developer does not store Your data on any external server, data retention is governed by Your iCloud account settings and Apple’s data retention policies.

When You delete the app or remove its data from iCloud, Your data is deleted in accordance with Apple’s iCloud data deletion procedures.


8. Your Rights Under GDPR

Under the General Data Protection Regulation, You have the following rights:

  • Right of access: You can view all Your data directly within the app and in Your iCloud account settings.
  • Right to rectification: You can edit or correct Your data directly within the app at any time.
  • Right to erasure: You can delete Your data by removing the app and its associated data from Your iCloud account via iOS Settings.
  • Right to data portability: Your data is stored in Your personal iCloud account and is accessible through Your Apple ID.
  • Right to withdraw consent: You can withdraw consent for push notifications at any time through Your device settings.
  • Right to lodge a complaint: You have the right to lodge a complaint with a supervisory authority. The competent authority in Germany is the data protection authority of the respective federal state (Landesdatenschutzbeauftragte).

Since all data is stored in Your personal iCloud account, You have full and direct control over Your data at all times.


9. Children’s Privacy

Our Service is not intended for anyone under the age of 18. We do not knowingly collect personal data from children. If You are a parent or guardian and become aware that Your child has used the Service, please contact us so we can take appropriate action.


10. Changes to This Privacy Policy

We may update this Privacy Policy if required (e.g., if we start using additional services). We will notify You of any significant changes within the app or via the App Store. We will provide at least 30 days’ notice before any material changes take effect.
